Any transaction carried out with PARADIGME85, owner of the website www.boitier-e85.com, will be governed exclusively by the general terms and conditions of sale detailed below.
PROVISIONS APPLICABLE TO ORDERS PLACED AND CONTRACTS CONCLUDED:
ART. 1
ACCEPTANCE OF THESE GENERAL TERMS AND CONDITIONS OF SALE AND WARNINGS
1.1 – Acceptance of these terms and conditions of sale
By completing the order form on the website or confirming the order by payment, a user (hereinafter referred to as “the customer”) fully and completely accepts these general terms and conditions of sale, which shall be the only terms applicable to the contract thus concluded.
1.2 – Warning
Our company distributes control units (currently not approved in France) strictly for motorsport use and disclaims all liability whatsoever for any invalidation of a manufacturer's warranty, mechanical or electronic failure, or insurance coverage. We disclaim all liability in the event of use on public roads.
Be aware that any modification or installation, even a simple change of car radio, on a recent vehicle may cause you to lose the Manufacturer's Warranty.
Therefore, the installation may void the warranty offered by the manufacturer.
1.3 – Technical Specifications
The condition of the vehicle and the type of its engine influence the power increase provided by our units. Therefore, the figures in our sales documents specifying fuel consumption or power increase should not be considered a contractual commitment, as they are provided for informational purposes only.
ART. 2
ORDER CONFIRMATION AND CONTRACT CONCLUSION
Payment for items is made in euros (EUR) only by bank transfer or credit card via Stripe.
Payment for the item(s) by the customer constitutes an order and full and complete acceptance of these general terms and conditions of sale.
boitier-e85.com reserves the right to cancel an order at any time without giving a specific reason.
ART. 3
GENERAL COMMITMENTS OF THE PARTIES
3.1 – Commitments of boitier-e85.com
boitier-e85.com undertakes, except in cases of force majeure, upon acceptance of an order, to deliver the said items ordered by the customer to the address indicated by the customer at the time of the order, within the limits of available stock.
3.2 – User Commitments
The customer agrees to clearly indicate the address to which the delivery should be made during business hours.
The customer agrees to pay the stated price of the item to be delivered; delivery can only take place after receipt of payment for said order by boitier-e85.com
The customer agrees to take responsibility for complying with applicable laws regarding the installation and use of the ordered equipment.
The customer agrees to take all necessary insurance arrangements regarding the installation and use of the ordered equipment.
3.3 – Right of Withdrawal
In accordance with the provisions of Article L 121-20 of the Consumer Code, the Customer has a right of withdrawal.
This legal withdrawal period of 14 days applies only to products purchased online.
The customer has 14 calendar days from the date of receipt of their products to request a return authorization number from boitier-e85.com customer service by email or telephone. Once the return authorization number is obtained, they have an additional 10 calendar days to return the product. Upon receipt of the product, if its condition meets the conditions outlined in section 3.4, the customer will be offered an exchange or a refund, according to their preference.
After this 10-day period, the product(s) cannot be returned.
If the Customer has requested a return from Customer Service within 14 calendar days of receiving their products, but returns the package after the 10-day period from the date of obtaining the return number, only a credit note or an exchange will be offered, and this is limited to a maximum of 30 calendar days from the date of receipt of the products. After this 30-day period, the product(s) cannot be returned.
In the event of the exercise of the right of return by the Customer and in accordance with the provisions of Article L. 121-20 of the Consumer Code, the costs of returning the Order shall be borne by the customer.
Items must be returned in perfect new condition and in their entirety, including accessories, packaged and packed as originally and without any trace of use in order to allow the products in question to be resold, and accompanied by the original purchase invoice.
Compliance with these conditions will entail PARADIGME85 refunding the customer within thirty (30) days the amounts paid, equivalent to the total cost of the returned products. Shipping and/or handling fees are non-refundable.
Only products returned complete, in their original packaging, in perfect condition for resale and accompanied by the original purchase invoice, will be accepted.
For any incomplete, damaged, or defective item, or any item whose original packaging has been damaged, PARADIGME85 reserves the right to refuse a refund or to charge a product restoration fee ranging from €77 to €228. In this case, the exact amount will be communicated to the customer after verification of the condition of the returned products.
If the customer refuses to pay for the repairs, the products will be returned to the customer at their expense.
3.4 – Product Return Procedure
To exercise their right of return, the Customer must first contact Customer Service within the time limits stipulated in Article 10.2, directly from the page Contact > Return marchandises
The Customer will then receive a return confirmation email containing their return number, called RMA.
In the event of a return of merchandise, the Customer must ship part or all of the Order at their own expense to the address that will be provided to them by Customer Service.
3.5 – Cancellation
boitier-e85.com reserves the right to cancel any order at any time without giving a specific reason.
ART. 4
SPECIFIC PROVISIONS
4.1.1 – Responsibility of boitier-e85.com
boitier-e85.com is not liable for any direct or indirect damages resulting from the purchase and/or use of the items ordered. boitier-e85.com is not liable for any violations of applicable laws resulting from the purchase and/or use of items sold on www.boitier-e85.com
4.1.2 – Customer Responsibilities
The customer is solely responsible for any direct and indirect damages, and offenses committed, caused by the purchase and/or use of items purchased on www.boitier-e85.com or any other website or distributor marketing in any way items supplied through www.boitier-e85.com.
4.1.2 – Price, invoice
The total price shown when placing an order through boitier-e85.com is the final price. This price includes the cost of the items, handling fees, packaging, loading fees, and shipping costs.

4.2 – Transport – delivery – delivery times
Products shipped by www.boitier-e85.com are delivered within 3 to 8 days (depending on the chosen carrier) after payment via an accepted payment method. In all cases, the maximum delivery time is 30 business days. Our items are available worldwide, subject to stock availability at www.boitier-e85.com. Deliveries to certain countries are only possible subject to acceptance by the carrier chosen by boitier-e85.com.
4.2.1 – Additional and customs fees
For products originating from countries outside the EEC, customs duties and VAT may be payable upon receipt of the order by the customer. www.boitier-e85.com does not contribute in any way to the payment of such charges.
4.2.2 – Returns – Refunds
Returns by the customer are not permitted without our prior agreement, subject to the specific terms and conditions below regarding mail order sales. Only exchange requests will be considered. Return shipping costs are the responsibility of the customer, who is required to return the product in new condition and in its original packaging.

4.2.3 - Guarantee
The Ethanol Starflex® and 2.0 Wifi® boxes are guaranteed for a period of 2 years with the possibility of extending to 5 years at an additional cost.
The warranty contract only covers Ethanol Starflex® and 2.0 Wifi® units. If a customer notices a problem with one of our units and returns it to us, the warranty provides for its repair or replacement after the fault has been verified in our workshops.
Should our products require disassembly and reassembly, the labor costs will be charged to the customer who returned the product. The warranty is valid only under normal use of the product; it will be void in the event of faulty installation or installation not performed by a professional who has verified the overall condition and proper functioning of the vehicle.
In all areas, and particularly in those defined by Articles 1641 et seq. of the French Civil Code, our guarantees are limited to the replacement of defective parts or products, as well as shipping and handling costs. The customer remains responsible for any costs related to the assembly and disassembly of the product. Our company cannot under any circumstances be held liable for damages, regardless of the reason.
PARADIGME85 accepts no responsibility for any engine malfunction or damage that may occur after the installation of the ethanol kit or its accessories. Our company will not offer any warranty in the following cases: force majeure, negligence or lack of maintenance, improper use, faulty installation, or installation performed by a person lacking professional skills.
www.boitier-e85.com offers a 2 (two) year or 5 (five) year warranty, depending on the option chosen, against any manufacturing defect, under the following conditions:
- In all cases the warranty can only be applied after examination of the items concerned by the after-sales service of boitier-e85.com.
- In the event that our products need to be disassembled and reassembled, the labor costs will be charged to the customer who returned the product to us.
- Only normal use of the product allows the use of the warranty, which would become void in the event of defective assembly or assembly not carried out by a professional who has taken care to check the good condition as well as the proper functioning of the vehicle as a whole.
- The warranty does not cover any damage caused directly or indirectly by the use of the equipment.
- The warranty does not cover breakage, except for breakage occurring during shipment to the buyer and according to the terms defined in article 4.4 of these terms and conditions of sale.
- No warranty can be applied until the buyer has returned the faulty equipment to www.boitier-e85.com
- The shipping costs incurred for the application of the warranty are the responsibility of the buyer.
- The decision to repair, replace, or refund, in whole or in part, the equipment covered by the warranty rests entirely with www.boitier-e85.com
In the event of a dispute concerning the application of these terms of sale, only the commercial court of Aix en Provence (France) shall have jurisdiction.
4.3 – Risk Transfer
boitier-e85.com's responsibility ceases once the items are handed over to the carrier. The items travel at the customer's sole risk.
4.4 – Reservations upon receipt of products and limited cases of refund/replacement
boitier-e85.com accepts the validity of the dispute, on the part of the customer, only when the items delivered do not correspond to the quantities or models ordered or if the package containing the items is found to be seriously damaged before delivery to the customer.
Detailed reservations must be noted in writing, dated and signed on the Delivery Note with the carrier upon delivery. A copy or photocopy of the document containing the reservations must be sent to boitier-e85.com (Email or mail) no later than twenty-four (24) hours after noting the reservations.
If the above procedure has been followed, and if the claim is proven valid, due to the fact that the package and items are severely damaged, boitier-e85.com reserves the right to refund the price paid by the customer or make a new delivery of similar items upon receipt of the damaged merchandise returned to our address.
If the delivery does not conform quantitatively or qualitatively to the order, and in the event that the customer wishes to keep the items received, boitier-e85.com undertakes to refund only the possible difference in price between the products ordered and those delivered, only if the products delivered are of lower price than those ordered and paid for.
The ordered item will either be exchanged or refunded as soon as possible.
ART. 5
DISABILITY – FORCE MAJEURE – APPLICABLE LAW – JURISDICTION
In the event that any clause of these General Terms and Conditions of Sale is, for any reason whatsoever, declared invalid or unenforceable, this event of impossibility shall not affect the application of the other provisions of the general terms and conditions; the one deemed unenforceable shall then be replaced by the closest possible provision.
boitier-e85.com cannot be held responsible for any failure to perform which would have as its origin a case of force majeure, beyond its control, including in particular, but not limited to, cases of war, riot, insurrection, interruption of transport, import or export problem, customs, strike, lockout, shortage of items, fire, avalanche, creeping snow, earthquake, storm, flood.
These general conditions are governed by French law.
Any difficulty in interpretation or execution shall fall exclusively under the jurisdiction of the competent courts of Aix-en-Provence (France). In the event of any dispute or disagreement, after the parties have unsuccessfully attempted to reach an amicable agreement, only the Commercial Court of Aix-en-Provence (France) shall have jurisdiction to settle the dispute.
